  1. mBED END USER LICENSE AGREEMENT
  2. REDISTRIBUTION NOT PERMITTED

  5. BY CLICKING ON THE "ACCEPT" BUTTON, YOU ARE CONSENTING TO
  6. BE BOUND BY THIS AGREEMENT.  IF YOU DO NOT AGREE TO ALL OF
  7. THE TERMS OF THIS AGREEMENT, CLICK THE "DO NOT ACCEPT"
  8. BUTTON AND THE INSTALLATION PROCESS WILL NOT CONTINUE.

  11. 1.    GRANT OF LICENSE.  mBED Software, Inc., San Francisco,
  12. California ("mBED") grants you a non-exclusive license to
  13. use this mBED Plug-In software (the "Software") free of
  14. charge.  You are authorized to make copies of the Software
  15. for archival purposes and to make copies for the use of
  16. other persons or entities ("Persons"), provided that each
  17. copy made must contain all of the original Software's
  18. proprietary notices including a complete reiteration of
  19. this End User License Agreement which the Person to whom a
  20. copy is transferred must read and agree to accept.  This
  21. license does not entitle you to hard-copy documentation,
  22. support or telephone assistance. All rights not expressly
  23. granted are reserved to mBED.

  25. 2.    RESTRICTIONS.  YOU MAY NOT:
  26.  
  27. A.    Decompile or disassemble the Software or in any manner
  28. reverse engineer the Software or back develop algorithms
  29. for the Software for any purpose whatsoever.
  30.  
  31. B.    Remove any proprietary notices from the Software.
  32.  
  33. C.    Prepare modifications or adaptations of the Software or
  34. create derivative works based on the Software.
  35.  
  36. D.    Lease, sell, license, distribute or otherwise transfer
  37. interests in the Software.
  38.  
  39. E.    Bundle or otherwise combine the Software with any other
  40. software or product for any purpose.
  41.  
  42. F.    Copy or permit copying of the Software, except for the
  43. purposes permitted herein.

  45. 3.    DISCLAIMER OF WARRANTY.  THE SOFTWARE IS PROVIDED ON AN
  46. "AS IS" BASIS.  mBED EXPRESSLY DISCLAIMS ALL WARRANTIES,
  47. EXPRESS OR IMPLIED, REGARDING THE SOFTWARE, INCLUDING
  48. WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY,
  49. FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE
  50. ENTIRE RISK AS TO THE QUALITY, FUNCTION AND PERFORMANCE OF
  51. THE SOFTWARE IS BORNE BY YOU.  SHOULD THE SOFTWARE PROVE
  52. DEFECTIVE, YOU AND NOT mBED OR ITS SUPPLIERS ASSUME THE
  53. ENTIRE COST OF THE SERVICE AND REPAIR.  SOME JURISDICTIONS
  54. DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO THIS
  55. DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER
  56. LEGAL RIGHTS THAT VARY BY JURISDICTION.

  58. 4.    TITLE.  Title, ownership rights, and intellectual
  59. property rights in the Software shall remain exclusively in
  60. mBED.  The Software is protected by copyright and other
  61. intellectual property laws and by international treaties.  
  62.  
  63. 5.    TERMINATION.  This license is effective until
  64. terminated.  You may terminate this license at any time by
  65. destroying the Software and all copies thereof.  This
  66. license will terminate automatically upon your failure to
  67. comply with the restrictions set forth above.  Upon
  68. termination of this license, you agree to destroy the
  69. Software and all copies thereof.

  71. 6.    MISCELLANEOUS.  This Agreement represents the complete
  72. agreement between the parties pertaining to the subject
  73. matter hereof, and supersedes any and all written or oral
  74. agreements previously existing between the parties with
  75. respect to such subject matter.  If any provision of this
  76. Agreement is held to be unenforceable, such provision shall
  77. be reformed only to the extent necessary to make it
  78. enforceable.  This Agreement shall be governed by
  79. California law (except for conflict of law provisions). 
  80. The application of the United Nations Convention of
  81. Contracts for the International Sale of Goods is expressly
  82. excluded.  If you have any questions regarding the nature
  83. and extent of the license granted hereby, please write to

  87. 7.  LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND
  88. UNDER NO LEGAL THEORY, TORT, CONTRACT OR OTHERWISE, SHALL
  89. mBED OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY
  90. OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR
  91. CONSEQUENTIAL DAMAGES OR LOSS OF ANY CHARACTER INCLUDING
  92. WITHOUT LIMITATION, DAMAGES FOR COMPUTER FAILURE OR
  93. MALFUNCTION, OR ANY OTHER LOSSES THAT RESULT FROM THE USE
  94. OF THE SOFTWARE OR RELATED DOCUMENTATION, EVEN IF mBED or
  95. any mBED AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE
  96. POSSIBILITY THAT mBED'S TOTAL LIABILITY FOR ALL DAMAGES,
  97. LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT,
  98. INCLUDING NEGLIGENCE, OR OTHERWISE) EXCEED THE AMOUNT PAID
  99. BY YOU FOR THE SOFTWARE.  SOME STATES DO NOT ALLOW THE
  100. EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL
  101. DAMAGES, SO THAT THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

  103. 8.  U.S. GOVERNMENT END USERS.  The Software is a
  104. "commercial item", as that the term is defined in 48 C.F.R.
  105. 2.101 (Oct. 1995), consisting of "commercial computer
  106. software" and "commercial computer software documentation",
  107. as such terms are used in 48 C.F.R. 12.212 (Sept. 1995). 
  108. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1,
  109. users acquire the Software with only those rights set forth
  110. herein.

  112. 9.    EXPORT CONTROLS.  None of the Software or underlying
  113. information or technology may be downloaded or otherwise
  114. exported or reexported (i) into (or to a national or
  115. resident of) Cuba, Iraq, Libya, Yugoslavia, North Korea,
  116. Iran, Syria or any other country to which the U.S. has
  117. embargoed goods; or (ii) to anyone on the U.S. Treasury
  118. Department's list of Specially Designated Nationals or the
  119. U.S. Commerce Department's Table of Denial Orders.  By
  120. downloading or using the Software, you are agreeing to the
  121. foregoing and you are representing and warranting that you
  122. are located in, under the control of, or a national or
  123. resident of any such country or on any such list.
